Reimbursement of flight and expenses

Firstly, a passenger who is a victim of flight cancellation or overbooking can ask the airline for a refund of his or her flight ticket. Once the passenger has made this request, European Regulation EC 261/2004 provides for a period of 7 days for the airline to refund the spent sum.

For passengers who are prevented from continuing their journey with stopovers due to cancellation or overbooking, it is possible for them to request a flight back to their home airport from the airline. This right may be exercised in jointly with the right to a refund.

But the European regulation also gives you another possibility. Instead of applying for a refund, you can quite simply ask the airline for an alternative flight. This flight can get you to your destination in the shortest possible time, or later (subject to seat availability), depending on your wishes.

If your journey has been delayed for more than 5 hours, you can request a refund of your ticket. This delay must be noted on arrival, in which case it gives you the same rights of refund as a passenger affected by a cancellation or overbooking. You will therefore be able to request a return flight jointly with the refund, if the delay occurs in the context of a stopover. Or you can request an alternative flight.

Airline assistance

Secondly, a cancelled, delayed or overbooked flight entitles you to assistance from the airline. This includes :

  • The proposal of refreshments and snacks in sufficiency;
  • The ability to make two phone calls or send two emails, free of charge.

You are entitled to assistance if either of these two situations are familiar to you:

Your flight has been cancelled or overbooked, and you have chosen to accept the alternative flight offered to you.
You are then entitled to assistance during the waiting period for this replacement flight.

Your flight has been delayed.
You have the right to be taken care of while you are waiting for departure.

However, please note that not all flight delays give rise to an obligation of assistance on the part of the airline company.

Indeed, the framework within which a flight delay can give rise to a right to care is laid down in European legislation :

  • Minimum 2 hours delay for flights of less than 1500 km;
  • Minimum 3 hours delay for flights of more than 1500 kms within the European Union and 1500 to 3500 kms for other flights;
  • 4 hours minimum delay for all flights over 3500 kms.

 

My flight doesn't leave until tomorrow.

In this case, the airline's obligation to provide assistance will extend to hotel accommodation.

The airline will have to provide you with a means of access if the chosen hotel is not directly accessible from the airport, and offer you the night because of the wait for your flight.

 

The airline that operated my flight did not assist me

Since the airline did not assist you, you surely have had to assume the additional costs resulting from the flight disruption, whether it be accommodation, food or transportation costs.

Nevertheless, the airline is not supposed to be able to evade its obligation to provide assistance. In application of European Regulation EC 261/2004, you may request reimbursement of the sums paid by keeping your payment receipts.

    Compensation for flight disruptions

    Finally, the cancellation, delay or overbooking of a flight may entitle you to compensation, provided that the flight meets certain conditions.

    First of all, depending on where your airport of departure or arrival is located, the regulation may require the airline operating the flight to be European in order to be applied.

    • If your flight departs from a European airport.
      Regulation EC 261/2004 does not take into account the nationality of the airline to apply.
    • If your flight lands at a European airport.
      The airline operating the flight must be of European nationality for the regulation to apply.

    After that, the regulation sets out two conditions that can be qualified as general in order to be entitled to compensation.

    • You have kept your booking confirmation ;
    • You have taken into account the check-in time limit mentioned by the airline company, or in the absence of any mention, you have checked in no later than 45 minutes before take-off.

    Then, the conditions corresponding to the incident that affected your trip are taken into account.

    Denied boarding
    Passenger compensation is stipulated immediately, and does not require any special conditions.

    Delay
    Its duration must be a minimum of 3 hours in order to give rise to a claim for compensation. Only the delay on arrival is taken into account.

    Cancellation
    The airline must have given you sufficient notice of cancellation so that the regulation can be applied. Therefore, you will not be entitled to compensation if the company has respected a notice period:

    • More than two weeks in advance;
    • Between 7 days and 2 weeks in advance, if an alternative flight departing no earlier than 2 hours before the scheduled departure and arriving less than 4 hours after the scheduled arrival has been offered by the airline ;
    • Less than 7 days in advance, if an alternative flight departing no earlier than 1 hour before the scheduled departure and arriving less than 2 hours after the scheduled arrival has been offered by the airline.

    If your flight does not fall within this framework, European legislation entitles you to compensation, with one exception. The airline must be responsible for the flight disruption. In other words, the cause of the disruption must not qualify as an extraordinary circumstance. Such circumstances cannot be invoked if the disruption is the result of the activity of the air carrier and it had the capacity to foresee it.

    The amount of this allowance varies according to the distance of the flight concerned. It amounts to :

     

    • 250€ for a flight of less than 1500 kms, cancelled, overbooked or more than 3 hours late;
    • 300€ for a flight of more than 3500 kms with a delay of more than 4 hours;
    • 400€ for a flight of more than 1500 kms within the European Union and for all other flights from 1500 to 3500 kms, cancelled, overbooked or more than 3 hours late;
    • 600€ for a flight of more than 3500 kms called extra-community (i.e. it comes from or goes to a country outside the European Union), cancelled, overbooked or more than 4 hours late.
