Alternatively, you can ask the airline for an alternative means of transport to your destination.

The second thing you are entitled to in the event of a cancelled, delayed or overbooked flight is assistance from the airline. The airline's duty to provide assistance includes :

  • The provision of food and drinks;
  • The ability to make two phone calls or send two emails.

There are two cases in which this assistance should be offered to you.

Either you are facing a flight cancellation or an overbooking situation and you have chosen to request a routing to your destination from the airline.
In which case, the airline will be obliged to assist you during the waiting period for the replacement flight.

Or you're facing a flight delay.
The airline company will then have to take care of you while you wait before boarding.

However, not all flight delays require the airline to assist you.

European Regulation (EC) No 261/2004 lays down the framework within which this obligation may be implemented:

  • 2 hours delay or more for flights of less than 1500 kms;
  • 3 hours delay or more for flights over 1500 kms within the European Union and 1500 to 3500 kms for other flights;
  • 4 hours delay or more for all flights over 3500 kms.

 

What if the flight's rescheduled for the next day?

In the event that the airline can only offer you a flight departing the next day, its duty to assist will also apply.

Thus, it will have to offer you hotel accommodation, as well as transport to and from the hotel if it is not directly accessible from the airport.

What if the company didn't assist you?

In this case, you were certainly forced to pay the costs resulting from the disruption of your flight. However, the assistance provided for in the European regulation is an obligation that airlines have to respect. If they fail to do so, they must reimburse you for the costs resulting from a flight cancellation, delay or overbooking, whether or not they are responsible for it.

Keep your receipts for taxi fares, hotel accommodations or meals. These proofs of purchase will allow you to obtain a refund.

    Compensation for flight disruptions

    Finally, the third thing you are entitled to in case of cancellation, delay or overbooking of a flight is compensation.

    However, several conditions are necessary in order to be entitled to compensation.

     

    First of all:

    Your departure airport is located in the European Union.
    Regardless of the airline, the European regulation EC 261/2004 may apply.

    Your airport of arrival is located in the European Union.
    In this case, the head office of the airline operating the flight must be located in the European Union for the regulation to apply.

     

    Secondly, there are two general conditions necessary for the eligibility of your flight.

    • You have your flight reservation ;
    • You have checked in before the check-in deadline indicated on your reservation, or if not, no later than 45 minutes before departure time.

     

    Also, there are conditions specific to the type of flight disturbance encountered.

    Your flight was overbooked.
    Your right to compensation in case of overbooking is not dependent on any specific conditions.

    Your flight's been delayed.
    In the case of a flight delay, the delay must be at least 3 hours to be eligible for compensation. Please note that this is the delay on arrival at the final destination. Therefore, in the case of stopovers, it is the delay on arrival of the last flight.

    Your flight's been cancelled.
    In the case of a flight cancellation, your right to compensation depends on how long you were given notice of the cancellation.

    In the event of cancellation, you are entitled to compensation, unless the airline has notified you :

    • At least 2 weeks before the scheduled departure time ;
    • From 7 days to 2 weeks prior to the scheduled departure time if they offered you a re-routing departing no earlier than 2 hours before the scheduled departure time and arriving at the final destination less than 4 hours after the originally scheduled departure time ;
    • Less than 7 days prior to the scheduled departure time if they offered you a re-routing departing no earlier than 1 hour before the scheduled departure time and arriving less than 2 hours later than originally scheduled.

     

    Thus, if your flight falls within this framework and the airline is responsible for the flight disruption, i.e. it was caused by its activity and control, your flight may entitle you to compensation.

    The amount of this compensation depends not on the price of your ticket, but on the flight distance.

     

    • 250€ for a flight of less than 1500 kms, cancelled, overbooked or more than 3 hours late;
    • 300€ for a flight of more than 3500 kms with a delay of more than 4 hours;
    • 400€ for a flight of more than 1500 kms within the European Union and for all other flights from 1500 to 3500 kms, cancelled, overbooked or delayed more than 3 hours;
    • 600€ for a flight of more than 3500 kms called extra-community, i.e. it comes from or goes to a country outside the European Union, cancelled, overbooked or more than 4 hours late.
