How do I get compensation for a Turkish Airlines flight?

A Turkish Airlines flight cancelled, delayed or overbooked?

Entrust your claim to Sky Indemnity, our experts will assert your rights to the best of their ability. Your claim will be fully taken care of by our team, and we guarantee you compensation as soon as possible.

The company

Turkish Airlines

With more than 75 million passengers reaching their destination in 2018, Turkish Airlines is the 6th largest airline in Europe.

Its fleet consists of 357 aircraft serving a record 315 destinations worldwide. The 126 countries it serves make its coverage the most extensive in the world.

The airline has been a member of the Star Alliance since 2008.

    Compensation made available

    The right to compensation is relatively unknown to the general public. However, Regulation EC 261 allows passengers whose flights have been cancelled, delayed or overbooked to receive compensation from the airline.

    However, airlines often choose to complicate the recovery of such compensation when passengers request it.

    Through a mandate, Sky Indemnity will deal with the airline regarding compensation.

    Your claim will be taken care of in full and our team will use its knowledge of the processes used by the airlines to make the best use of your rights.

    How to be compensated?

    In order to be eligible for compensation, the flight must comply with three prerequisites laid down in Regulation (EC) No 261/2004 :

    • Be in possession of your boarding pass or booking confirmation;
    • To have respected the check-in time limit mentioned by Turkish Airlines ;
    • The airport of departure or arrival is located in the European Union.

    It is important to note that if only the airport of arrival is located in the European Union, the airline operating the flight must be European for the regulation to apply. As Turkish Airlines is based in Istanbul, a flight from a third country to an EU Member State operated by Turkish Airlines will therefore fall outside the eligibility framework.

    To find out the eligibility of your flight in less than two minutes, use our compensation calculator.

    Based on your flight information, it will tell you whether your flight is eligible and the amount of compensation.

    Compensation for cancelled Turkish Airlines flight

    Firstly, the cancellation of a Turkish Airlines flight gives you the right to request a refund from the airline.

    If this flight cancellation prevents you from taking one of the stopovers of your trip, you will also be entitled to a return flight to your home airport.

    Second, flight cancellation may make you eligible for compensation under certain conditions. One of these conditions is that Turkish Airlines respects the notice period.

    European law will not allow you to claim compensation if the airline has warned you:

    • More than two weeks before the departure date;
    • Between 7 days and 2 weeks before the departure date, if an alternative flight leaving no earlier than 2 hours before the scheduled departure and arriving less than 4 hours after the scheduled arrival has been offered to you ;
    • Less than 7 days before the departure date, if an alternative flight leaving no earlier than 1 hour before the scheduled departure and arriving less than 2 hours after the scheduled arrival has been offered to you.

    If the airline has notified you within this framework, you will then have to choose between :

    • Take the alternative flight offered by Turkish Airlines ;
    • Request a refund of your air ticket and book another flight;
    • Request a refund of your airline ticket and resign yourself to a postponement of your trip.

    However, if the airline has notified you too late, or if the proposed flight does not comply with the conditions, you may be entitled to claim compensation if the reason for the cancellation cannot be qualified as an extraordinary circumstance.

    If you don't know what caused the flight cancellation, you can use our compensation calculator to determine the eligibility of your flight.

    Compensation for delayed Turkish Airlines flight

    In order for the flight delay to give rise to rights for the passenger, it must respect a minimum duration depending on the distance of the flight.

    Thus, Turkish Airlines will be obliged to provide assistance to its passengers if the delay exceeds :

    • 2 hours for flights of less than 1500 kms;
    • 3 hours for flights of more than 1500 kms within the European Union and from 1500 to 3500 kms for other flights;
    • 4 hours for all flights over 3500 kms.

    This assistance will then include:

    • The ability to have meals ;
    • Hotel accommodation if necessary;
    • The provision of a means to make two phone calls or send two emails.

    From a duration of 5 hours, a flight delay also entitles you to a refund from the airline. Provided, of course, that European Regulation EC 261/2004 can apply.

    Concerning the right to compensation, the minimum required is a delay of 3 to 4 hours, taking into account the flight distance.

    The overbooked Turkish Airlines flight

    As optimizing the load factor of their aircraft has become a key element in the profitability of airlines, overbookings regularly occur.

    The EU regulation gives passengers denied boarding the same choice as passengers whose flights have been cancelled. These are as follows:

    • Taking the alternative flight offered by the airline;
    • Book another flight and get a refund;
    • Request reimbursement for the flight and cancel the trip.

    Compensation is deemed "immediate" by the regulation, but this obligation is rarely followed by airlines.

    How much can you claim?

    The amount you are entitled to varies according to the distance of the flight you have booked.

    • 250€ for a cancellation, denied boarding or a delay of more than three hours on flights less than 1500 kms away;
    • 300€ for flights with a delay of between three and four hours, with a distance of more than 3500 kms;
    • 400€ for cancelled, overbooked or delayed flights of more than three hours, whose distance is between 1500 kms and 3500 kms (or more than 1500 kms within the European Union) ;
    • 600€ for cancelled, overbooked or delayed flights of more than four hours, whose route exceeds 3500 kms.

      Why entrust us with your claim?

      Airlines sometimes make it difficult to recover compensation from passengers who are entitled to it.

      It is common for them to offer discount coupons or "miles" to be used later (and which happen to fall far short of what you are entitled to), or they may simply refuse your claim.

      The airline's denial of compensation leaves the only recourse for passengers trying to assert their rights to the courts. A solution whose costs often exceed what compensation allows them to obtain.

      By entrusting your claim to Sky Indemnity, you ensure that your claim is fully handled and that you receive your compensation in the shortest possible time.

      Thanks to their knowledge of European law and the actions of airlines, the experts in our team will enforce your rights in the best possible way.

      Our team will take charge of processing your claim with the airline and will try to find an amicable solution with them.

      If, however, the company is reluctant to provide compensation and we believe that it violates your rights, we will provide you with an efficient legal remedy at no cost to you.

      Check that your flight is eligible, you can recover up to €600!
