What to do in the event of flight disruptions related to Covid-19?

 Saturated customer services, taxed assets, difficult to obtain reimbursements: airlines are not the only ones to suffer the consequences of the Covid-19 epidemic.

 

Already relatively reluctant to compensate passengers affected by flight delays or cancellations, the health crisis has prompted many airlines to complicate the recovery of refunds for passengers, but also for companies and their employees. 

Credit notes do not apply to airlines.

Under cover of financial difficulties, many airlines have adopted behaviour aimed at complicating refunds and encouraging passengers or companies to accept compensation in credit notes, valid for 12 to 18 months.

However, while the ordinances of last March allow tourism professionals to offer credit notes as the sole method of reimbursement, these measures do not apply to air-only bookings.

As stated in Article 11 of the Order of 23 March last:

"It does not cover the sale of tickets, which is otherwise regulated by international law and European Union legislation on passenger rights. »

The airlines are therefore in breach of Regulation (EC) No 261/04 by offering credit notes as the only means of reimbursement in order to convince a large number of passengers to accept this method of reimbursement.

Because according to the European regulation, if the applicant accepts the refund of credit notes, it is no longer possible to obtain a cash refund before the end of the validity of the accepted credit notes.

However, you have every right to refuse the proposal for the repayment of credit notes and to demand the repayment of the sums due to you

Is one of your flights involved?

In the case of a dry flight

A dry flight is a reservation that includes only one or more flights. If this is the case for you, there are two cases that involve different refund rights.

  •  You cancelled your flight

As a general rule, it is not possible to cancel a flight ticket without incurring additional costs if the flight is maintained. However, the airline is not allowed to apply cancellation fees to passengers who have cancelled their tickets due to health risks.

For example, if you have booked a flight to a country where there is a health risk and you decide to cancel your trip as a precaution, the airline will normally not charge you a cancellation fee.

However, be aware that the company will not be held to any obligation to reimburse. In this specific case, therefore, your refund depends solely on the goodwill of the airline.

  •  The airline cancelled your flight

In order for your flight to be subject to European regulations, it is necessary that :

 - The airport of departure is located in a member state of the European Union.

Or that

 - The airport of destination is located in a member state of the European Union, and the airline operating the flight is European.

Provided that your flight is subject to European regulations, the flight cancellation will fall within the scope of extraordinary circumstances.

As such, Regulation (EC) No 261/04 gives you the right to a full refund of your air ticket(s).

In the case of a package tour

Also known as a "tourist package" or "package tour", a package tour is a set of services offered at a fixed price by travel organisations.

If your travel reservation includes a service complementary to transportation (accommodation, on-site activities, meals, etc.), it is part of a package tour.

As mentioned, an order passed by the Council of Ministers on 23 March this year gives travel organisations the possibility of issuing assets only in response to claims for reimbursement.

These assets must have the same value as the cancelled trip and can be used within 18 months, whether for a postponement of stay or a change of destination.

However, if the credit expires without being used, you can claim a rebate from the travel organization.
