This may be a situation you're familiar with. It is important to know that if you have a reservation that includes flights operated by different airlines, each of them will be held responsible for the flight cancellation or delay on arrival of its segment.

Also, delay criteria apply to qualify for assistance from the airline. European Regulation EC 261/2004 stipulates that the delay must be within the framework of :

  • 2 hours or more for flights of less than 1500 kms;
  • 3 hours or more for flights over 1500 kms within the European Union and 1500 to 3500 kms for other flights;
  • 4 hours or more for all flights over 3500 kms.

If one of its flights falls within this framework, the responsible air carrier is obliged to provide assistance to its passengers. This duty of assistance shall include :

  • Supply of food and drinks while waiting;
  • Hotel accommodation and transportation to the hotel if necessary;
  • The possibility to make two phone calls.

The airline may not have provided you with assistance and thus forced you to pay for the costs associated with the delay of your flight. In this situation, keep your receipts. They will allow you to claim a reimbursement later.

Also, as part of a trip with at least one connection, any flight that is cancelled or delayed more than 5 hours gives you the opportunity to :

  • request a refund of the full price at which your ticket was purchased, for the part(s) of the journey not made and for the part(s) already made that are no longer necessary in relation to the original plan of travel ;

and

  • be offered a return flight to your original departure airport as soon as possible.

In the event of a flight cancellation, you also have the option of requesting a routing to your final destination from the airline that operated your flight.

However, if your trip includes several flights operated by different airlines, each carrier is only responsible for its own section. It is therefore essential to distinguish between parts of trips operated by different airlines. For example, to determine a passenger's entitlement to assistance, reimbursement or re-routing to the final destination, the EU regulation considers each section of the journey operated with an airline independently.

What compensation in case of a missed connection?

Back in France, you are probably wondering whether your injury is compensable.

First of all, the European regulation sets three initial conditions that must be met in order for you to be entitled to compensation:

  • You have your flight reservation ;
  • You went to the check-in door before the deadline mentioned on your reservation. If your reservation does not mention a deadline, you must have arrived no later than 45 minutes before the departure of the aircraft;
  • The airport of departure or arrival of your journey is located in a country of the European Union. In the case of a flight from a third country to a member country, the airline must be based in the European Union for your flight to be entitled to compensation.

If your flight meets these conditions and the reason for the delayed flight is not due to extraordinary circumstances, your flight may be eligible for compensation. For any delay of more than 3 hours, the amount of compensation depends on the distance of your journey. The amount is :

  • 250€ for flights of less than 1500 kms ;
  • 300€ for flights of more than 3500 kms;
  • 400€ for flights over 1500 kms within the European Union and for all other flights from 1500 kms to 3500 kms ;
  • 600€ for flights of more than 3500 kms, called extra-community flights, i.e. those coming from or going to a country outside the European Union, with a delay of more than 4 hours.

As with reimbursement, the responsibility for compensation lies with the airline for the corresponding section of the journey.

    What if there's a strike?

    Missed connections due to flight delays or cancellations due to strikes are a possibility to be considered. In determining the eligibility of your flight, the nature of the strike is paramount. According to the European regulation, there are two types of strikes:

    • Unwanted and unpredictable strike by the airline.
      In this case, the airline is usually exempt from paying compensation. Generally speaking, these are strikes that do not involve the airline's staff, as it can be the case with strikes by air traffic controllers or the airport security staff.
    • The strike due to the staff and the activity of the airline.
