This is a situation you may have experienced before. Maybe you even had to pay for a night in a hotel because the cancellation forced you to take a flight the next day.

Yet the cancellation of a flight forces the airline to take care of its passengers. How does the European regulation define this assistance?

First of all, any passenger whose flight is cancelled is faced with a choice between :

  • Request a replacement flight from the airline. It must then offer you a mean of re-routing to your final destination under the same conditions and as soon as possible (or at a later date depending on seat availability).

However, if you choose the second option, your re-routing may not be possible in the shortest possible time. The airline company may offer you a flight departing the next day, for example. These waiting times may involve additional accommodation and food costs. However, the cancellation of your flight entitles you to an appropriate care from the airline.

This assistance includes :

  • The provision of drinks and food during the waiting period;
  • Hotel accommodation if a stay of one or more nights is necessary, as well as possible transport to the hotel;
  • The ability to make two phone calls.

If during the waiting time for your replacement flight the airline did not provide you with assistance and you were forced to find accommodation and meals at your own expense, keep your receipts. They will allow you to claim a refund.

Flight cancellation compensation

Once back in France, you ask yourself the question: what about the prejudice I suffered? Does the loss of my time entitle me to compensation?

European Regulation EC 261/2004 sets out three conditions for the eligibility of a flight:

  • Be in possession of your flight reservation;
  • Have arrived before the check-in deadline indicated on the reservation, or if not mentioned, no later than 45 minutes before departure;
  • The airport of departure or destination is located in a member country of the European Union, and for travel from outside to inside the European Union, the airline must be based in a member country.

If you meet these criteria and the reason for cancellation does not fall within the scope of extraordinary circumstances, you can recover, according to the European regulation, a flat-rate compensation ranging from €250 to €600. This amount depends on the distance travelled:

  • 250€ for flights of 1500 kms and less;
  • 400€ for flights of more than 1500 kms within the European Union and for all other flights from 1500 to 3500 kms ;
  • 600€ for flights of more than 3500 kms called extra-community flights, i.e. those coming from or going to a country outside the European Union.

Compensation for flight cancellation in the event of a strike

Be aware that a strike that disrupts your trip by causing your flight to be cancelled may entitle you to compensation. This right depends on the nature of the strike, there are two types of strike according to the articles of the European regulation EU 261/2004 :

  • The strike by non-airline personnel. In this case, the airline is not obliged to pay compensation as it is a situation which the carrier considers to be unwanted and unforeseeable.
  • The airline staff strike. In this case, the carrier is obliged to compensate you because it is an event which cannot be considered as an extraordinary circumstance, as far as it can foresee.

It is not easy for passengers to know whether the strike involves airline staff or not. That is why we advise you to ask the airline for the reason for the cancellation when it occurs.

 

The airline's refusal to pay compensation

The airline may refuse your compensation provided that it has given you sufficient notice. It will be exempted from paying compensation for periods of advance notice:

  • At least 2 weeks before departure;
  • Between 7 days and 2 weeks prior to departure, if you have been offered a flight that allows you to leave no earlier than 2 hours before the scheduled departure time and arrive less than 4 hours after the scheduled arrival time;
  • Less than seven days before departure if they have offered you a flight that will depart no earlier than one hour before your scheduled time of departure and arrive less than two hours after your scheduled time of arrival.

Therefore, the airline will escape its obligation to compensate passengers if the cause of cancellation falls within the scope of extraordinary circumstances. That is to say, an event that is outside the airline's activity and beyond its control. Many events may constitute extraordinary circumstances, for example :

  • Extreme weather conditions;
  • Airspace closure;
  • A strike by non-airline personnel.

Nevertheless, airlines sometimes refuse compensation on the grounds of extraordinary circumstances which have not been proven. For example, certain grounds for cancellation entitle you to compensation, such as :

  • Technical problems;
  • A lack of personnel (no crew or pilot) ;
  • The illness of the crew members.

A lack of cooperation from the airline forces you to initiate legal proceedings to assert your rights. But with defence costs between 150€ and 200€ per hour, a lawsuit is not the most optimal solution to obtain compensation.
