Maybe the same thing happened to you. However, according to European Regulation EC 261/2004, when a passenger is denied boarding, the airline is obliged to provide assistance. But what form does this assistance take?

First of all, a passenger who is denied boarding has the choice between:

  • The rerouting to the final destination under comparable transport conditions, as soon as possible or at a later date, depending on passenger's will and the availability of seats.

If the airline offers you a flight that is scheduled to depart the next day, the delay may result in additional charges. These costs are normally included in the assistance that the airline has to provide you with. This situation obliges the airline to take care of passengers who have been denied boarding. Thus, the duty of assistance obliges the airline to :

  • Provide freerefreshmentsand sufficient food and drinks ;
  • Provide hotel accommodation if a stay of one or more nights is necessary and transportation to the hotel;
  • Give the opportunity to make two phone calls.

But if you were not covered by the airline, you may have been forced to pay the additional costs while waiting. In this case, keep your receipts. They will allow you to obtain a refund of the amounts incurred.

Compensation in case of overbooking of the plane

When you return from your trip, you may be wondering if the incident on your flight entitles you to compensation. And indeed: denied boarding as a result of overbooking entitles you to a flat-rate compensation ranging from €250 to €600.

The European Regulation EU 261/2004 sets three prerequisites for a flight to be eligible for compensation:

  • You must have the flight reservation ;
  • You must be present before the check-in deadline mentioned on your booking confirmation (if not, you must be present no later than 45 minutes before departure);
  • Your airport of departure or arrival must be located in a European Union country. If only your destination airport is located in an EU country, the head office of the airline that operated your flight must be located in an EU country.

If your flight falls within this framework, you are entitled to a lump-sum compensation which is deemed to be immediate. Its amount depends on the flight distance and ranges from 250 to 600 euros.

  • For flights of less than 1500 kms : 250 euros
  • For flights of more than 1500 kms within the European Union and for all other flights from 1500 to 3500 kms: 400 euros
  • For flights of more than 3500 kms from or to  the European Union : 600 euros

The airline's refusal to pay compensation
